Toronto Accessory Dwelling By-Laws

Durham Region allows accessory dwelling units like basement apartments and garden suites, provided they meet local by-laws for zoning, safety, and property standards.

What are Toronto accessory units?

Some municipalities may allow the construction of Garden Suites or Laneway Suites on larger properties. These suites often have their own separate entrance and utilities and are generally allowed in areas where properties have enough space.

Size and Height

The suite must not be taller than 4.0 meters in height and the greater of 42 sq meter. It must be approximately 5% of the house in size. Plus, 0.6 meter setback is required along the side and rear property lines.
